# I am Spanish: can I form a SAS or SASU in France?

Updated : 2026-10-24 · Source : https://legalrapide.fr/en/reponses/citoyen-espagnol-creer-societe-france/

Yes. Like any European Union citizen, a Spanish national **does not need a residence permit** to form and run a company in France, whether resident in France or in Spain. The steps, documents and fees are the same as for a French citizen: €223.56 incl. VAT in legal fees for a SASU in mainland France, at current rates.

## What changes if you live in Spain
| Topic | In practice |
|---|---|
| Identity | Valid DNI or passport; generally no translation needed |
| Registered office | An address in France is mandatory: an approved domiciliation provider if you have no premises |
| Capital | Deposit into an account in the name of the company in formation, at a bank that accepts non-residents |
| Signature | Articles of association signed electronically, with no need to travel |

## Social security if you work in both countries
If a substantial part of your activity (at least 25% of your working time or income) takes place in Spain, where you live, Spanish social security generally applies. If you combine work as an *autónomo* in Spain with the presidency of a French SASU, have your situation confirmed before paying yourself.

## With LegalRapide
LegalRapide accepts founders who are EU, EEA and Swiss nationals, whether they live in France or abroad. The Essentiel plan is €0 excl. VAT: you pay only the legal fees.

## FAQ
**Do you need an NIE or a French tax number to form the company?**
No. The company receives its SIREN number on registration; no personal French tax number is required to form it.
