Often yes, depending on your role in the company. The president of a SAS or SASU is treated as an employee for social security: they can keep their micro-entreprise. So can a minority or equal manager of a SARL. On the other hand, the sole shareholder who manages an EURL and the majority manager of a SARL cannot: like the micro-entrepreneur, they come under the self-employed social security scheme, where the same person cannot be registered twice.
Depending on your role in the company
| Role | Keeping the micro-entreprise |
|---|---|
| President or managing director of a SAS / SASU | Yes |
| Shareholder of a SAS, SARL or EURL with no management role | Yes |
| Minority or equal manager of a SARL | Yes |
| Majority manager of a SARL | No |
| Sole shareholder and manager of an EURL | No |
The same activity in both: the real risk
Combining is meant for distinct activities. Invoicing the same service to the same clients sometimes through the micro-entreprise and sometimes through the company has no economic justification other than benefiting from the micro regime: Bpifrance Création strongly advises against it because of the tax risk. If the company takes over your activity, see instead moving from a micro-entreprise to a company. bpifrance-creation.fr
What does not change
- You cannot have two micro-entreprises, or a micro-entreprise and another sole proprietorship.
